State Compliance With Commercial Driver's License Program: Notification Of Traffic Violations

Required notification with respect to CDL holders. Whenever a person who holds a CDL from another State is convicted of a violation of any State or local law relating to motor vehicle traffic control (other than a parking violation), in any type of vehicle, the licensing entity of the State in which the conviction occurs must notify the licensing entity in the State where the driver is licensed of this conviction within the time period established in paragraph (c) of this section.

Whenever a person who does not hold a CDL, but who is licensed to drive by another State, is convicted of a violation in a CMV of any State or local law relating to motor vehicle traffic control (other than a parking violation), the licensing entity of the State in which the conviction occurs must notify the licensing entity in the State where the driver is licensed of this conviction within the time period established in paragraph (c) of this section.

Commercial Motor Vehicle

Definition:
Any self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property when the vehicle (1) has a gross vehicle weight rating or gross combination weight rating or gross vehicle weight or gross combination weight, of more than 10,000 lbs or 4,536 kg or (2) used for commercial transport of more than 8 passengers (including the driver); or (3) is used for non-commercial transport of more than 15 passengers, including the driver; or (4) is used in transporting material found by the Secretary of Transportation to be hazardous under 49 U.S.C. 5103 and transporting in a quantity requiring placarding under regulations prescribed by the Secretary under 49 CFR, subtitle B, chapter I, subchapter C.

Authorized Speed Limit

Definition:
Authorized speed limit for the motor vehicle at the time of the crash. The authorization may be indicated by the posted speed limit, blinking sign at construction zones, etc.

Area(s) of Impact

Definition:
The areas of damage to the motor vehicle caused by the crash. These areas should include the area of the motor vehicle that received the initial impact and the area that was most damaged.
